Terms of Service

These Terms of Service govern the access and use of paweldomanski.eu, the provision of free electronic services, and the terms of professional technology advisory, 1-on-1 consultations, and engineering workshops.

1. General Provisions & Service Provider Information

The platform paweldomanski.eu is operated by:

These Terms are made available free of charge prior to entering into any agreement in a format allowing their retrieval, storage, and reproduction.

2. Definitions

  • Platform / Website: The website operating at paweldomanski.eu.
  • Service Provider: Paweł Domański as identified in Section 1.
  • Client / User: Any natural person, legal entity, or organizational unit using the Platform or purchasing Advisory Services.
  • Consumer: A natural person entering into a transaction unrelated directly to their business or professional activity (Article 22[1] of the Polish Civil Code).
  • Sole Trader on Consumer Rights (PNPK): A natural person running a sole proprietorship entering into a contract directly related to their business activity, where the contract does not possess a professional character for them (Article 385[5] of the Polish Civil Code).
  • Advisory Services: Paid professional services including 4-hour 1-on-1 consultations, engineering workshops, and Fractional CTO retainer partnerships.

3. Electronically Supplied Services

The Service Provider provides the following complimentary electronic services:

  • Browsing published technical articles, database schemas, and service descriptions.
  • Direct contact form for submitting architectural and database inquiries.
  • Interactive live chat widget (Chatwoot) for real-time messaging.
  • Architectural newsletter subscription and downloadable engineering blueprints.

Technical Requirements: An Internet connection, an up-to-date web browser (Chrome, Firefox, Safari, Edge) supporting HTML5/CSS3/JavaScript, and an active email address.

Prohibition of Unlawful Content: Users are strictly prohibited from transmitting unlawful content, unsolicited commercial communications (spam), or malicious software.

4. Advisory Engagement Formats & Availability Quotas

We provide three structured advisory formats:

  • 1-on-1 Architectural Consultation (4h): Intensive deep-dive audit of PostgreSQL / Oracle databases, pgvector, or multi-agent AI architecture. Includes an executive Markdown summary and architectural roadmap.
  • Live Team Workshop: Hands-on technical workshops delivered remotely or on-site for engineering teams.
  • Fractional CTO: Monthly retainer partnership for strategic architecture governance, code review, and database migration leadership.

Strict Availability Limits: To preserve uncompromising engineering rigor and eliminate subcontracting, all services are personally delivered by Paweł Domański. Strict caps apply: maximum 2 individual consultations per week and 2 active retainer partnerships per month.

5. Booking, Pricing, and Invoicing

  • Engagements are booked via the contact form, direct email (kontakt@paweldomanski.eu), or integrated calendar scheduling (Cal.com).
  • An agreement is formed upon mutual confirmation of scope, date, and fee terms.
  • Prices are quoted in Polish Złoty (PLN) or Euros (EUR) as net amounts, subject to statutory 23% VAT where applicable.
  • Settlements are conducted on a B2B basis via VAT invoice, payable by wire transfer to the bank account specified on the invoice.

6. Consumer Rights & Statutory Withdrawal

Clients who qualify as Consumers or Sole Traders on Consumer Rights (PNPK) are entitled to withdraw from a distance contract within 14 calendar days without providing any reason. For full instructions, exceptions, and the statutory withdrawal template, see our Returns & Complaints Policy.

Early Service Execution (Art. 38(1)(1) of the Consumer Rights Act): If a Consumer or PNPK requests the execution of an advisory service (such as an urgent 1-on-1 consultation) before the expiration of the 14-day withdrawal period, the Service Provider requires express consent acknowledging that upon full performance of the service, the right of withdrawal is forfeited.

7. Intellectual Property & Copyright

All blueprints, articles, code snippets, architectural diagrams, and written materials on paweldomanski.eu are proprietary works protected under copyright law. Clients purchasing advisory services receive a non-exclusive, perpetual internal license to use deliverables within their organization.

8. Confidentiality & Non-Disclosure (NDA)

The Service Provider treats all proprietary database schemas, source code, and business intelligence shared during consultations with absolute confidentiality. A bilateral Non-Disclosure Agreement (NDA) is executed upon request prior to inspecting client production assets.

9. Complaints & Dispute Resolution

Complaints regarding service delivery or website availability must be submitted to kontakt@paweldomanski.eu. All consumer complaints are resolved within 14 calendar days.

Consumers may utilize out-of-court dispute resolution mechanisms, including consumer ombudsmen and the European Commission Online Dispute Resolution (ODR) platform at: https://ec.europa.eu/consumers/odr.

10. Governing Law & Jurisdiction

These Terms are governed by the laws of Poland. For commercial B2B relationships not subject to consumer protection laws, the Service Provider's total liability is limited to the fee paid for the engagement, and exclusive jurisdiction rests with the courts having jurisdiction over the Service Provider's registered seat.
